The behavior of kissing while fasting into Sawm and Roza comes with two types of validity which are permitted and prohibited actions.

That which is prohibited is if he cannot be surethat he will not render his fast invalid.

That which is permissible is of two types:

According to Ash-Sharh al-Mumti‘ (6/429) kissing recieves the same legal status as other potentially leading to sexual intercourse activities and there exists no legal distinction between them.

Does kissing break your fast?

During Ramadan, the late Shaykh ‘Abd al-‘Aziz ibn Baz (may his soul rest in peace) received a question about whether male-spouse-to-wife physical contact during daylight invalidates fasting.

He replied:

The Prophet (blessings and peace of Allah be upon him) demonstrated through his behavior that a man can kiss his wife touch her and remain intimate with her during fasting days since these actions do not violate fasting rules. The Prophet demonstrated the permissibility of kissing his wife and touching her during fasting times because this is what he practiced.

The prohibition becomes makruh when he thinks he might perform what Allah has declared forbidden due to his high level of sexual desire. After ejaculation his daily eating activities stop until nighttime and he must follow the fast rules but he does not require any penalty offering according to the majority opinion.

Ruling on kissing (Can You Kiss During Ramadan?)

Any man who kisses his marital partner when fasting must perform the missed fast following Ramadan’s conclusion because his fast becomes unrighteous.

Ibn Qudamah said: 

According to Al-Mughni 4/361 (Can You Kiss During Ramadan?) there is legal consensus about fasting being broken by the actions of a fasting person who kisses his wife until he reaches ejaculation.

The requirement to perform expiation applies only when somebody breaks their fast through sexual intercourse since expiation remains mandatory only for fasting violations of this nature.
